1. General Provisions

These Terms and Conditions govern the purchase of goods from the online store vesadrinks.com operated by Nordic Functional Brands SIA, registration number 40203700406, VAT number LV40203700406, registered address Puces iela 49-53C, Riga, Latvia.

By placing an order in our Online Store, you agree to be bound by these Terms.

These Terms are prepared in accordance with the laws of the Republic of Latvia and European Union consumer protection regulations.

The Seller reserves the right to amend these Terms at any time. The applicable Terms are those in effect at the time of placing the order.

Product Description: We sell VĒSĀ functional nootropic beverages, classified as food supplements under Latvian and EU law.

Product Specifications:

• Format: 330ml aluminum cans
• Caffeine content: 100mg per can (303mg/L)
• Contains Rhodiola Rosea extract (150mg per can)
• Sugar-free, contains sweeteners (Sucralose, Acesulfame K)

Warnings and Contraindications:

• High caffeine content. Not recommended for children, pregnant or breastfeeding women.
• Do not exceed recommended daily dose (1 can per day).
• Not intended as a substitute for a varied and balanced diet.
• Keep out of reach of children.
• Consult your doctor before use if you have any medical conditions.

Age Restriction: Our products are intended for adults aged 18 and over. By placing an order, you confirm that you are at least 18 years old.

We strive to display product information accurately. However, actual product packaging may vary slightly from images shown.

5. Prices and VAT

All prices displayed in the Online Store are in Euros (EUR) and include VAT at the applicable rate (21% for Latvia).

Prices are valid at the time of order placement. The Seller reserves the right to change prices without prior notice, but changes do not affect orders already placed.

The total price includes: Product price (including VAT), Delivery costs (displayed before payment), Deposit fees where applicable (€0.10 per can for Latvian deposit system).

For business customers (B2B) with valid EU VAT numbers from other EU countries, reverse charge may apply.

6. Payment Methods

Payments are processed securely by our payment provider:

• Bank Link – Direct bank payments via Swedbank, SEB, Citadele, Luminor, and other Baltic banks
• Credit/Debit Card – Visa, Mastercard, and other major cards
• Apple Pay – Where supported
• Google Pay – Where supported

All payments are made in Euros (EUR).

Your payment is processed immediately upon order confirmation. The order is confirmed once payment is successfully received.

The Seller does not store your payment card details. All payment data is processed securely by Montonio in accordance with PCI DSS standards.

If payment fails, the order will not be processed. You may attempt to place the order again.

7. Delivery

Delivery Area

• Latvia (all addresses)
• Lithuania (parcel machines and courier)
• Estonia (parcel machines and courier)

Additional countries may be added. Check the checkout for current availability.

Delivery Methods and Times

Delivery times are estimates and may vary due to carrier workload or circumstances beyond our control.

Delivery Costs

Delivery costs are calculated at checkout based on your location and selected delivery method.

Free shipping is available for orders over €50 (before deposit fees) within Latvia.

Order Processing

• Orders placed before 14:00 (EET) on business days are typically dispatched the same day.
• Orders placed after 14:00 or on weekends/holidays are dispatched the next business day.
• You will receive a tracking number via email once your order is dispatched.

Parcel Machine Collection

When your parcel arrives at the selected parcel machine:

• You will receive an SMS and/or email notification with a pickup code.
• Parcels must be collected within 7 days (varies by carrier).
• Uncollected parcels will be returned to us.

Failed Delivery

• Customer's fault (wrong address, not home, expired pickup): Customer bears the cost of redelivery.
• Carrier's fault: We will arrange redelivery at no additional cost.
• Our fault (wrong product, damaged packaging): We will arrange redelivery at no additional cost.

8. Transfer of Risk and Ownership

Risk of loss or damage to the products passes to the Customer upon delivery (when the Customer or their designated third party takes physical possession of the goods).

Ownership of the products transfers to the Customer upon full payment.

9. Right of Withdrawal (Cooling-Off Period)

In accordance with EU Consumer Rights Directive and Latvian Consumer Rights Protection Law, you have the right to withdraw from the contract within 14 calendar days without giving any reason.

The withdrawal period expires 14 days from the day on which you (or a third party indicated by you) acquires physical possession of the goods.

Effects of Withdrawal:

• We will reimburse all payments received from you, including delivery costs (except additional costs if you chose a delivery method other than the least expensive standard delivery offered by us).
• Reimbursement will be made within 14 days from the day we receive the returned goods or proof of return.
• Reimbursement will be made using the same payment method used for the original transaction, unless you expressly agree otherwise.

Returning the Products:

• You must return the products within 14 days of communicating your withdrawal.
• You bear the direct cost of returning the products.
• Products must be returned in original condition, with all packaging intact.

Exceptions to Right of Withdrawal:

The right of withdrawal does not apply to:

• Sealed goods which are not suitable for return due to health protection or hygiene reasons, if the seal has been broken after delivery.
• Products that have been opened, consumed, or tampered with.

Important: As food supplements, our products are exempt from the right of withdrawal once the seal on the packaging (shrink wrap or can seal) has been broken.

10. Returns and Refunds

Defective or Damaged Products

• Contact us within 48 hours of delivery with photos of the damage.
• We will arrange a replacement or full refund at no cost to you.
• Do not dispose of the damaged product until instructed.

Wrong Product Received

• Contact us within 48 hours of delivery.
• We will arrange collection and send the correct product.
• Full refund if the correct product is not available.

Quality Issues

• Contact us with details and batch number (printed on can).
• We will investigate and respond within 5 business days.
• Legitimate quality issues will result in replacement or refund.

Refund Processing Time

Actual processing time depends on your bank.

11. Warranty and Liability

All products are covered by the statutory warranty period of 2 years from delivery, as required by EU law.

The warranty covers defects in materials and workmanship that were present at the time of delivery.

The warranty does not cover:

• Damage caused by improper storage or handling.
• Normal wear and tear.
• Products that have been opened and cannot be returned for hygiene reasons.

To the maximum extent permitted by law, our liability for any claim arising from or related to the products shall not exceed the price paid for the products.

12. Deposit System (Depozīta sistēma)

In accordance with Latvian law, our beverage cans are subject to the deposit system.

A deposit fee of €0.10 per can is added to the product price at checkout.

Customers can return empty cans to designated collection points (Taromāts) to receive the deposit refund.

13. Intellectual Property

All content on the website vesadrinks.com, including but not limited to text, graphics, logos, images, and software, is the property of Nordic Functional Brands SIA and is protected by copyright and other intellectual property laws.

The VĒSĀ brand name, logo, and related trademarks are registered trademarks of Nordic Functional Brands SIA.

You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.

14. Limitation of Liability

The Seller is not liable for:

• Delays or failures in performance due to circumstances beyond our reasonable control (force majeure).
• Actions or omissions of third-party delivery providers.
• Indirect, incidental, or consequential damages.

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence.
• Fraud or fraudulent misrepresentation.
• Any liability that cannot be excluded by law.

15. Dispute Resolution

These Terms are governed by the laws of the Republic of Latvia.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any order confirmation, constitute the entire agreement between you and us regarding your purchase.

Any amendments to these Terms must be made in writing.

18. Language

These Terms are provided in English. In case of any discrepancy between language versions, the English version shall prevail.

Latvian language version available upon request.

19. Acceptance of Terms

By placing an order in our Online Store, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.
